A letter received from Senator Robert Menendez of
New Jersey regarding Barack Obama’s eligibility issues:
“Thank you for contacting me regarding your support for the cases
brought before the Supreme Court regarding President-Elect Obama’s dual
nationality at birth. Your opinion is very important to me, and I
appreciate the opportunity to respond to you on this vital issue.
These cases allege that President-Elect Obama’s Hawaiian birth
certificate is counterfeit or that he may have dual citizenship.
However, based on state health department records, Hawaii state
officials have confirmed that Barack Obama was born August 4, 1961,
in Hawaii. That means he is a natural born citizen, and thus, eligible
to serve as President of the United States.
As you may have heard, on December 8, 2008, the US Supreme Court turned
down the emergency appeal in one of these cases. Other appeals have been
dismissed in the federal courts of Pennsylvania, Ohio and Washington State.

Senator Robert Menendez stated:
“These cases allege that President-Elect Obama’s Hawaiian birth
certificate is counterfeit or that he may have dual citizenship.”
It is apparent that senator Menendez is not up to speed on the court
cases in the US Supreme Court and state courts. The counterfeit aspect,
pertains to Versions of Obama’a alleged COLB, not a birth certificate,
that have been placed on the internet. This is not one of the major
arguments. It is documented, not conjecture, that Obama had dual
citizenship. Obama’s father was Kenyan, under British rule. The
remaining question is whether Obama had Kenyan or US citizenship as
well.
Mr. Menendez then stated:
“However, based on state health department records, Hawaii state

Hawaii Health Dept. Officials never stated that Obama was born in
Hawaii. See below.
Mr. Menendez then stated:
“That means he is a natural born citizen, and thus, eligible
to serve as President of the United States.”
Being born in Hawaii is not sufficient to make Obama a natural born
citizen. If it did, then British citizens vacationing in Hawaii and
delivering a child would enable that British child to be president.
Mr. Menendez then stated:
“As you may have heard, on December 8, 2008, the US Supreme Court turned
down the emergency appeal in one of these cases. Other appeals have been
dismissed in the federal courts of Pennsylvania, Ohio and Washington State.”
What is Senator Menendez trying to say here? It is obvious that he does
not have a clue.

“A press release was issued on October 31, 2008, by the Hawaii Department
of Health by its Director, Dr. Chiyome Fukino. Dr. Fukino said that she
had “personally seen and verified that the Hawaii State Department of
Health has Senator Obama’s original birth certificate on record in
accordance with state policies and procedures.” That statement failed to
resolve any of the questions being raised by litigation and press accounts.
Being “on record” could mean either that its contents are in the computer
database of the department or there is an actual “vault” original.”
“Further, the report does not say whether the birth certificate in the
“record” is a Certificate of Live Birth or a Certificate of Hawaiian Birth.
In Hawaii, a Certificate of Live Birth resulting from hospital documentation,
including a signature of an attending physician, is different from a
Certificate of Hawaiian Birth. For births prior to 1972, a Certificate of
Hawaiian Birth was the result of the uncorroborated testimony of one witness
and was not generated by a hospital. Such a Certificate could be obtained up
to one year from the date of the child’s birth. For that reason, its value
as prima facie evidence is limited and could be overcome if any of the
allegations of substantial evidence of birth outside Hawaii can be obtained.
The vault (long Version) birth certificate, per Hawaiian Statute 883.176
allows the birth in another State or another country to be registered in
Hawaii. Box 7C of the vault Certificate of Live Birth contains a question,
whether the birth was in Hawaii or another State or Country. Therefore,
the only way to verify the exact location of birth is to review a certified
copy or the original vault Certificate of Live Birth and compare the name of
the hospital and the name and the signature of the doctor against the
birthing records on file at the hospital noted on the Certificate of the
Live Birth.”
